Defenders Subjected to Profanity-Laced Tirade

SAN ANTONIO -- Eighty-four homeowners in the Mission Creek subdivision on the southside got foreclosure notices from their homeowners association last month, prompting an outcry from residents.

Now there are complaints from homeowners in the Voss Farms subdivision in New Braunfels.

Both HOAs are managed by the same company: RGD Realty and attorney Judith Gray.

One angry homeowner in Voss Farms is Jose Bernal.

"I receive a letter stating that my home may be foreclosed on," said Bernal

He said he paid his HOA dues and that a statement showed a zero balance due.

"RGD seems to be a total disaster," said another Voss Farms homeowner, Al Lewis.

They say their neighborhood isn’t well maintained and that annual dues have gone from $138 to $350.

Letters threatened some homeowners with liens on their homes and foreclosure if they didn’t pay up.

"There's something going on here," said Bernal.

The Defenders called RGD Realty in March and twice again in April and got no answers.

There was no reply to an email sent to the company.

RGD Realty has a post office box, but no listed physical address, so the Defenders went to Judith Gray’s home seeking a response to the complaints

A man answered the door and asked the Defenders to leave, then walked outside and threw a cup of water on reporter Brian Mylar.

Seeing a Defenders photographer on a public sidewalk, he launched a profanity-laced tirade.

"You worthless piece of F****** S***,” said the man. “Go ahead, record, put this on the air you worthless piece of S***, get out of here."

Last month when the Defenders came to this home to ask questions about the Mission Creek complaints, the same man grabbed the Defenders’ camera.

"You're on my property,” said the man. “Is that camera on? Is the camera on,” he said, continuing to grab for the camera.

The Defenders got no answers here from attorney Judith Gray.

So while unhappy residents are continuing to pay HOA dues, they still have to wonder where their money is going and when the next threatening letter will come.

"You can knock on any door and mention the name RGD and they'll all cringe," said another dissatisfied Voss Farms homeowner, Chip Roberts.

Homeowners who believe their HOA or management company is in the wrong can ask the Texas Attorney General’s office to investigate.

Another option is to hire a private attorney to sue on behalf of the residents.
